Artículo 22- Maltrato. A quien por cualquier medio golpee o maltrate físicamente a una mujer con quien mantenga o haya mantenido una relación o vínculo de pareja, sea matrimonial, unión de hecho, noviazgo, convivencia, de no convivencia, casual u otra análoga, aun cuando medie divorcio, separación o ruptura, siempre que la conducta no constituya un delito más grave o previsto con una pena mayor, sin que incapacite para sus ocupaciones habituales, se le impondrá pena de prisión de tres meses a un año.

 

Igual pena se impondrá cuando las conductas de maltrato se cometan en alguno de los supuestos establecidos en el artículo 21 bis de esta ley.

Si de la acción resulta una incapacidad para sus labores habituales menor a cinco días, se le impondrá pena de seis meses a un año de prisión, siempre que la conducta no constituya un delito más grave o previsto con una pena mayor.

 

A quien cause daño en el físico o a la salud de una mujer con quien mantenga o haya mantenido una relación o vínculo de pareja, sea matrimonial, unión de hecho, noviazgo, convivencia, de no convivencia, casual u otra análoga, aun cuando medie divorcio, separación o ruptura, siempre que la conducta no constituya un delito más grave o previsto con una pena mayor que le produzca una incapacidad para sus ocupaciones habituales por un tiempo mayor a cinco días y hasta por un mes, se le impondrá pena de prisión de ocho meses a dos años.
