Artículo 172- Trata de personas. Será sancionado con pena de prisión de seis a diez años, quien mediante el uso de las tecnologías o cualquier otro medio, recurriendo a la amenaza, al uso de la fuerza u otras formas de coacción, al rapto, al fraude, al engaño, al abuso de poder, a una situación de vulnerabilidad, o a la concesión o recepción de pagos o beneficios para obtener el consentimiento de una persona que tenga autoridad sobre otra, promueva, facilite, favorezca o ejecute, la captación, el traslado, el transporte, el alojamiento, el ocultamiento, la retención, la entrega o la recepción de una o más personas dentro o fuera del país, para someterlas a trabajos o servicios forzados y otras formas de explotación laboral, la servidumbre, la esclavitud o las prácticas análogas a la esclavitud, el matrimonio servil o forzado, la adopción irregular, la mendicidad forzada, el embarazo forzado y el aborto forzado y la ejecución de cualquier forma de explotación sexual.
La pena de prisión será de ocho a dieciséis años, si media, además, alguna de las siguientes circunstancias:
a) La víctima sea menor de dieciocho años de edad, persona adulta mayor o con discapacidad.
b) El autor sea cónyuge, conviviente o pariente de la víctima hasta el tercer grado de consanguinidad o afinidad.
c) El autor se prevalezca de su relación de autoridad o confianza con la víctima o su familia, medie o no relación de parentesco.
d) El autor se aproveche del ejercicio de su profesión o de la función que desempeña.
e) La víctima sufra grave daño en su salud, la muerte, o deceso por suicidio como consecuencia de la acción de trata de personas antes descrita.
f) El hecho punible haya sido cometido por un grupo delictivo integrado por dos o más miembros.
Será sancionado con la pena señalada en el primer párrafo de este numeral, quien promueva, facilite, favorezca o ejecute, la captación, el traslado, el transporte, el alojamiento, el ocultamiento, la retención, la entrega o la recepción de una o más personas dentro o fuera del país, para la extracción ilícita o el trasplante ilícito de órganos, tejidos, células o fluidos humanos.
Tratándose de personas menores de edad, para la configuración del delito no será necesario que se recurra a los modos de ejecución descritos en el primer párrafo de este artículo.
