Suspensión del procedimiento a prueba
Artículo 25- Procedencia. Cuando proceda la suspensión condicional de la pena o en los asuntos por delitos sancionados exclusivamente con penas no privativas de libertad, el imputado podrá solicitar la suspensión del procedimiento a prueba siempre que, durante los cinco años anteriores, no se haya beneficiado con esta medida ni con la extinción de la acción penal por la reparación del daño o la conciliación. Para tales efectos, el Registro Judicial llevará un archivo de los beneficiarios.
No procederá la medida en los delitos dolosos, cuando el hecho se haya cometido por medio de fuerza en las cosas o violencia sobre las personas. Este instituto procesal se podrá aplicar solamente en los delitos de violencia patrimonial contemplados en la Ley N.º 8589, Penalización de la Violencia contra las Mujeres, de 25 de abril de 2007, cuando no exista violencia contra las personas y siempre que se hayan tramitado con aplicación de la Ley de Justicia Restaurativa.
La solicitud deberá contener un plan de reparación del daño causado por el delito, a satisfacción de la víctima de domicilio conocido, y un detalle de las condiciones que el imputado está dispuesto a cumplir, conforme al artículo siguiente. El plan podrá consistir en la conciliación con la víctima, la reparación natural del daño causado o una reparación simbólica, inmediata o por cumplir a plazos. Si efectuada la petición aún no existe acusación, el Ministerio Público describirá el hecho que le imputa.
Para otorgar el beneficio son condiciones indispensables que el imputado admita el hecho que se le atribuye y que la víctima manifieste su conformidad con la suspensión del proceso a prueba.
En audiencia oral, el tribunal oirá sobre la solicitud al fiscal, a la víctima de domicilio conocido, así como al imputado, y resolverá de inmediato, salvo que difiera esa discusión para la audiencia preliminar. La resolución fijará las condiciones conforme a las cuales se suspende el procedimiento o se rechaza la solicitud y aprobará o modificará el plan de reparación propuesto por el imputado, según criterios de razonabilidad.
La suspensión del procedimiento podrá solicitarse en cualquier momento, hasta antes de acordarse la apertura a juicio, sin perjuicio de tramitarse con arreglo a la Ley de Justicia Restaurativa, y no impedirá el ejercicio de la acción civil ante los tribunales respectivos.
Si la solicitud del imputado no se admite o el procedimiento se reanuda con posterioridad, la admisión de los hechos por parte del imputado no podrá considerarse como una confesión.
Cuando el plan de reparación del daño causado por el delito incorpore el servicio de utilidad pública, deberá observar las regulaciones del artículo 56 bis del Código Penal.
