(Así adicionada la sección V anterior por el artículo 2° de la ley N° 9458 del 11 de junio de 2017. Anteriormente esta sección había sido adicionada por el artículo 2º de la ley No.7883 de 9 de junio de 1999, bajo el nombre: «Sección V: Delitos contra el ambiente.)

 

«Artículo 279 bis.- Crueldad contra los animales. Será sancionado con prisión de tres meses a un año, quien directamente o por interpósita persona realice alguna de las siguientes conductas:

 

a) Cause un daño a un animal doméstico o domesticado, que le ocasione un debilitamiento persistente en su salud o implique la pérdida de un sentido, un órgano, un miembro, o lo imposibilite para usar un órgano o un miembro, o le cause sufrimiento o dolor intenso, o agonía prolongada.

 

b) Realice actos sexuales con animales. Por acto sexual se entenderá la relación sexual de una persona con un animal, es decir, actos de penetración por vía oral, anal o vaginal.

 

c) Practique la vivisección de animales con fines distintos de la investigación.

 

Por animal doméstico se entenderá todo aquel que por sus características evolutivas y de comportamiento conviva con el ser humano. Por animal domesticado se entenderá todo aquel que mediante el esfuerzo del ser humano ha cambiado su condición salvaje.

 

La pena máxima podrá ser aumentada en un tercio, cuando el autor de estos actos los realice valiéndose de una relación de poder para intimidar, amenazar, coaccionar o someter a una o más personas, así como cuando la conducta se cometa entre dos o más personas.

 

Las organizaciones debidamente inscritas en el Registro Judicial podrán representar los intereses difusos de los animales afectados por las conductas descritas en esta norma.

Artículo 279 ter.-Muerte del animal. Se sancionará con pena de prisión de tres meses a dos años, a quien dolosamente, de forma directa o por interpósita persona, cause la muerte de un animal doméstico o domesticado; la misma pena se aplicará cuando la muerte de este sea consecuencia de las conductas descritas en los artículos 279 bis y 279 quinquies de esta ley.

 

Por animal doméstico se entenderá todo aquel que por sus características evolutivas y de comportamiento conviva con el ser humano. Por animal domesticado se entenderá todo aquel que mediante el esfuerzo del ser humano ha cambiado su condición salvaje.

 

Las organizaciones debidamente inscritas en el Registro Judicial podrán representar los intereses difusos de los animales afectados por las conductas descritas en esta norma.

 

Se tendrá por exceptuado de la aplicación de la pena prevista en este artículo, cuando se le cause la muerte al animal exclusivamente para el autoconsumo personal o familiar.
