EL CONTRATO DE PATROCINIO
CONCEPTO
El contrato de patrocinio publicitario es el acuerdo de voluntades por el que el patrocinado, a cambio de una contraprestación económica, generalmente destinada a la realización de su actividad deportiva, benéfica, cultural, científica o de otra índole, se compromete a colaborar en la publicidad del patrocinador.
El patrocinio es en esencia, la plasmación de una actividad publicitaria , una forma de publicidad en la que intervienen dos partes, el patrocinador-anunciante y el patrocinado.
Elementos del contrato:
- Prestación económica: Suele ser una ayuda que el patrocinador hace para que el patrocinado pueda llevar a cabo una actividad, cultural o deportiva, ayuda que debe ser valorable económicamente, en dinero (cantidad fija o fija y variable) o en bienes (por ejemplo, material para el ejercicio de la actividad), o mediante una combinación de ambas.
- Actividad ajena: La actividad del patrocinado no suele tener nada que ver con la actividad empresarial del patrocinador (ej. Un banco patrocina una expedición de montaña, un concierto o una exposición); pero en el caso de las aportaciones en especie no ocurre así, por ejemplo, un alpinista recibe ropa técnica para una expedición o el fabricante de cascos provee de estos a un motociclista de competición.
Debe diferenciarse con el Contrato de autorización para el uso de determinados derechos de imagen, por ejemplo un fabricante de carros cede un vehículo a un deportista a cambio de colaboración publicitaria, autorizando éste el uso de su imagen.
