– Inducción o instigación
El artículo 46 del Código Penal dispone que son instigadores, quienes intencionalmente
determinen a otro a cometer el hecho punible304.
La inducción o instigación se caracteriza porque una persona incita, impulsa, hace surgir
en otra (inducida o instigada) la idea de cometer un delito; pero quien decide y domina la
realización del mismo, es el inducido.
