El Procedimiento de Revisión de Sentencia Costa Rica

 

El Procedimiento de Revisión, es un mecanismo extraordinario que procederá contra las sentencias firmes y a favor de la persona condenada, o de aquel a quien se le haya impuesto una medida de seguridad y corrección. Comprende también aquellos casos en donde la pena o la medida de seguridad hayan sido ejecutadas o se encuentren extinguidas.

Conforme el artículo 408 del Código Procesal Penal, dicho procedimiento puede ser presentado en los siguientes casos:

a) Cuando los hechos tenidos como fundamento de la condena resulten inconciliables con los establecidos por otra sentencia penal firme.

b) Cuando la sentencia se haya fundado en prueba cuya falsedad se haya declarado en fallo posterior firme.

c) Si la sentencia condenatoria ha sido pronunciada a consecuencia de prevaricato, cohecho, violencia o maquinación fraudulenta, cuya existencia se haya declarado en fallo posterior firme, salvo que se trate de alguno de los casos previstos en el inciso siguiente.

d) Cuando se demuestre que la sentencia es ilegítima a consecuencia directa de la introducción de prueba ilegal o de una grave infracción a sus deberes cometida por un juez, aunque sea imposible proceder por una circunstancia sobreviniente.

e) Cuando después de la condena sobrevengan o se descubran nuevos hechos o nuevos elementos de prueba que solos o unidos a los ya examinados en el proceso evidencien que el hecho no existió, que el condenado no lo cometió o que el hecho cometido encuadra en una norma más favorable.

f) Cuando una ley posterior declare que no es punible el hecho que antes se consideraba como tal o que merece una penalidad menor, o bien, cuando la ley que sirvió de base a la condenatoria haya sido declarada inconstitucional

Las personas legitimadas para presentar un procedimiento de revisión (Art. 409) son:

1) La persona condenada o a quien se le haya aplicado una medida de seguridad y corrección. En caso de las personas incapaces, podrá presentarlo sus representantes.

2) El cónyuge, el conviviente con por lo menos dos años de vida común, los ascendientes, descendientes o hermanos, si el condenado ha fallecido.

3) El Ministerio Público.

Si durante el curso de la revisión, la persona condenada muere, dicha situación no paralizará el desarrollo del proceso.

Las formalidades para su interposición, se encuentran estipuladas en el artículo 410 del Código Procesal Penal.
