Obligaciones de los Trabajadores en Costa Rica

Código de Trabajo Costa Rica

ARTICULO 71.-

 

Fuera de las contenidas en otros artículos de este Código, en sus Reglamentos y en sus leyes supletorias o conexas, son obligaciones de los trabajadores:

 

Desempeñar el servicio contratado bajo la dirección del patrono o de su representante, a cuya autoridad estarán sujetos en todo lo concerniente al trabajo;
Ejecutar éste con la intensidad, cuidado y esmero apropiados, y en la forma, tiempo y lugar convenidos;
Restituir al patrono los materiales no usados y conservar en buen estado los instrumentos y útiles que se les faciliten para el trabajo; es entendido que no serán responsables por deterioro normal ni del que ocasione por caso fortuito, fuerza mayor, mala calidad o defectuosa construcción;
Observar buenas costumbres durante sus horas de trabajo;
Prestar los auxilios necesarios en caso de siniestro o riesgo inminente en que las personas o intereses del patrono, o de algún compañero de trabajo estén en peligro, nada de lo cual le dará derecho a remuneración adicional;
Someterse a reconocimiento médico, sea al solicitar su ingreso al trabajo o durante éste, a solicitud del patrono, para comprobar que no padecen alguna incapacidad permanente o alguna enfermedad profesional, contagiosa o incurable; o a petición de un organismo oficial de Salubridad Pública o de Seguridad Social, con cualquier motivo;
(El dictamen C-040-2008 de 8 de febrero de 2008 establece que la frase «alguna incapacidad permanente o» del presente inciso quedó tácitamente derogada por la Ley de Igualdad de Oportunidades para las Personas con Discapacidad (N° 7600 de 29 de mayo de 1996)

 

Guardar rigurosamente los secretos técnicos, comerciales o de fabricación de los productos a cuya elaboración concurran directa o indirectamente, o de los cuales tenga conocimiento por razón del trabajo que ejecutan; así como de los asuntos administrativos reservados, cuya divulgación pueda causar perjuicios al patrono, y
Observar rigurosamente las medidas preventivas que acuerden las autoridades competentes y las que indiquen los patronos, para seguridad y protección personal de ellos o de sus compañeros de labores, o de los lugares donde trabajan.
