Principios de un Juicio Oral y la Prueba

PRINCIPIO DE INMEDIACIÓN . El principio de inmediación exige que el Tribunal haya percibido por sí mismo la producción de la prueba. Es por eso que en nuestro proceso penal no es posible, en principio, sustituir el interrogatorio de testigos por la lectura de actas que recogen las declaraciones de los testigos durante la fase de instrucción. En nuestro ordenamiento jurídico es en el juicio oral en donde hay que practicar las pruebas, porque sólo lo que ha sido oralmente debatido en el juicio puede ser fundamento legítimo de la sentencia; así lo exige tanto el carácter público del proceso (art. 24.2 CE), como el derecho de defensa.

PRINCIPIO DE UNIDAD Y CONCENTRACIÓN La audiencia tiene carácter unitario. Si bien puede realizarse en diferentes sesiones, éstas son partes de una sola unidad. Esto debido a la necesidad de continuidad y concentración de la misma. La audiencia debe realizarse en el tiempo estrictamente necesario, las sesiones de audiencia no deben ser arbitrariamente diminutas ni indebidamente prolongadas. Así una sesión que termina es una suspensión, no una interrupción del juicio

EL PRINCIPIO DE CONTRADICCIÓN. E l principio de contradicción, inherente al derecho de defensa, es otro principio esencial en la práctica de la prueba, al permitir a la defensa contradecir la prueba de cargo.

PRINCIPIO DE LIBRE VALORACIÓN DE LA PRUEBA. En el sistema actual de libre valoración, el Juez es libre para obtener su convencimiento, porque no está vinculado a reglas legales sobre la prueba; puede convencerse por lo que le diga un único testigo frente a lo que digan varios. Ahora bien, el principio de libre valoración de la prueba no significa que el Tribunal tenga una facultad .libérrima y omnímoda sin limitaciones. El principio de libre valoración de la prueba significa que el Juez debe apreciar las percepciones durante el juicio según las reglas del criterio racional, es decir, según las reglas de la lógica, y, dentro de ellas, el principio de no contradicción, así como según los principios generales de la experiencia.

INVESTIGACIÓN OFICIAL DE LA VERDAD.- Se dirige cuando el interés público por la pena estatal ha sustituido al interés particular, incluso en materia probatoria[5]Es decir que el descubrimiento de la verdad tiene un rango alto de interés estatal y público y se asigna la titularidad de la inquisitio al Ministerio Público.

CONSTITUCIONALIDAD DE LA PRUEBA.-se exige que la prueba se obtenga sin afectar derechos fundamentales. Esto tiene su expresión en la prohibición de admisión, recepción o valoración de prueba ilícita.

RELEVANCIA.-Este principio señala que todos los elementos de prueba relevantes son admisibles, salvo que se disponga lo contrario. Funciona como regla incluyente, esto es, señalando que medios de prueba deben ser admitidos.

ORALIDAD.-Este principio instrumental es EMPLEADO por los sujetos procesales para transferir la información hacia el conocimiento del juzgador.

PUBLICIDAD.-Esta regla exige que el juicio sea público. Lo que hace es trasparentar la actuación probatoria como regla general, de tal forma que sobre ella exista control ciudadano.

COMUNIDAD DE LA PRUEBA.-Este principio determinada que una vez que se ha actuado el medio de prueba, este deja de pertenecer a quien lo ofreció y cualquier parte puede EMPLEARLO si así lo considera para reforzar su teoría del caso.

NO SON OBJETO DE PRUEBA.

Las máximas de la experiencia, las leyes naturales, las normas jurídicas internas vigentes, aquello que es objeto de cosa juzgada, lo imposible y lo notorio a continuación definiremos cada una:

  1. Máximas de la experiencia.- Son respuestas generales que dan las personas frente a determinadas situaciones de la realidad. En la doctrina se di que las máximas de la experiencia entrañan principios generales extraídos de la observación de los fenómenos físicos o del corriente comportamiento de los hombres y, como tales, sirven de apoyo para establecer una presunción o para efectuar la valoración de la prueba, funcionando en consecuencia como reglas distintas a establecer el sentido jurídico de la conducta
  2. Las leyes naturales.-Las leyes naturales no requieren probarse en un proceso penal, ya que el ámbito de su verificación corresponde a las ciencias naturales. Estas leyes que con un alto nivel de abstracción instituyen regularidades o relaciones causales no requieren su prueba en proceso, en principio porque son de naturaleza diferente. Las leyes naturales operan como premisa para esclarecer respecto del objeto de prueba. Las leyes de la física aplicables en balística, o la química cuando se trata de casos de envenenamiento, se convierten en un soporte para los expertos como los peritos que proveerán sus informes en juicio oral.
  3. La norma jurídica interna vigente.-La existencia de una norma tiene que ver más con un tema de interpretación que con el objeto de prueba. La norma jurídica es un enunciado que funciona como premisa para resolver un caso concreto. Las normas son públicas, surten efecto al día siguiente de su publicación y el juez está obligado a conocerla.
  4. Aquello que es objeto de cosa juzgada.- Los hechos dilucidados en un proceso penal que tiene la calidad de cosa juzgada no pueden a volver ser objeto de prueba en otro juicio, por ejemplo si una persona se le ha declarado inocente no puede volver a discutirse su responsabilidad penal.
  5. Lo imposible.-Es aquello que no puede ser verificado o contrastado con la realidad, es un enunciado factico que no tiene correlación con la realidad, como una suerte de quimera.
  6. Lo notorio.-Son aquellos conocimientos que maneja el común de la gente. En la doctrina se reconoce que se encuentran exentos de prueba los hechos notorios, en tanto el conocimiento de estos forman parte de la cultura normal propia de un determinado círculo social en el tiempo en que se produce la decisión.
