CONTRATO AUTORIZACION DE VENTA EXCLUSIVA
Nosotros, __________________ (nombre y apellidos), _____________________________ (estado civil), _____________________ (ocupación u oficio), _______________________ (documento de identidad: cédula de identidad, cédula de residencia, pasaporte), vecino de______________ (dirección exacta), quién en adelante y para efectos de esta autorización se denominará el PROPIETARIO; y __________________ (nombre y apellidos), _____________________________ (estado civil), _____________________(ocupación u oficio), _______________________ (documento de identidad: cédula de identidad, cédula de residencia, pasaporte), vecino de______________(dirección exacta), en su condición de ______con la representación judicial y extrajudicial y con facultades suficientes para este acto de la sociedad _____________., domicilio social en __________________ y con cédula jurídica ___________, inscrita en el Registro Personas Jurídicas tomo. . . . Asiento…, en adelante y para los efectos de esta autorización denominada el CORREDOR, debidamente asociada a la Cámara Costarricense de Corredores de Bienes Raíces CCCBR, cédula de persona jurídica 3-002-051042, número de asociada _____, convenimos en lo siguiente:
1.- Que el Propietario es dueño de la Finca inscrita en el Registro Público de la Propiedad que se describe de la siguiente manera:

GRAVAMENES HIPOTECARIOS Y/O DE OTRA NATURALEZA:
1.- AUTORIZACIONES EN GENERAL:
El PROPIETARIO autoriza al CORREDOR en forma EXCLUSIVA para promover la venta de la Propiedad antes descrita por un Monto de……………………………………..
El Propietario declara que no ha dado a otro Corredor igual autorización que esté vigente.
El Propietario autoriza al CORREDOR para colocar rótulo en la Propiedad: Si________ No_______. La publicidad que el CORREDOR utilizará para promover la venta de la Propiedad será: ____________________________________________________________

2.- CONDICIONES GENERALES
A) Si la Propiedad se vendiera a un cliente presentado y/o reportado por el CORREDOR,
El PROPIETARIO pagará al CORREDOR una COMISION del ______________% del total del precio de venta.
B) Dicha comisión será pagada incondicionalmente y al contado en el momento de formalizarse la venta y en la moneda que ésta se realice. En caso en que el Propietario reciba como parte de pago otro bien, no afectará el total del pago de la comisión.
4.- Si el PROPIETARIO vendiera directamente la propiedad, durante el plazo de esta autorización exclusiva de venta, deberá cancelar al CORREDOR el 50% de la comisión.
Además si el PROPIETARIO rescindiera el contrato, o decidiera que ya no la desea vender, tendrá que cancelar el 50% de la comisión aquí pactada en este contrato.
5.- Que esta autorización vence el día _________ de ________________ del ________ y se prorrogará automáticamente por períodos de ______________ si el PROPIETARIO no comunica al CORREDOR por escrito, por lo menos con 5 días de anticipación su deseo de darlo por terminado.
6.- Que si durante el plazo de vigencia de esta AUTORIZACION, el CORREDOR le reporta un cliente al PROPIETARIO, éste, durante el plazo de un año, contado a partir de la fecha de presentación o reporte del cliente, reconocerá al CORREDOR las comisiones aquí fijadas, si la Propiedad la vendiera a ese cliente. Es entendido que cliente incluye a los parientes, herederos, legatarios y socios del comprador, a él mismo y a las sociedades que represente.
7.- Que si habiéndose efectuado un depósito como señal de trato y la venta no llegara a formalizarse, dicho depósito será repartido entre el PROPIETARIO y el CORREDOR, otorgándole al CORREDOR su 50% de la comisión y siempre que este 50 % no sea mayor que el 50% de la comisión que el CORREDOR hubiera cobrado por la venta, en cuyo caso
el saldo será para el PROPIETARIO. ESTA COMISION NO SERA REEMBOLSADA BAJO NINGUNA CIRCUNSTANCIA.
8.- Que si esta propiedad se ALQUILARA, por decisión del PROPIETARIO, a un cliente presentado por el CORREDOR, éste tendrá derecho a cobrar la suma correspondiente a UN MES de renta, como comisión. Si el PROPIETARIO la vendiera al cliente inquilino, la propiedad, éste deberá pagar la suma correspondiente a la comisión pactada en esta Autorización al CORREDOR, rebajándose la suma pagada como comisión por el Alquiler.
9.- Todos los conflictos, controversias o diferencias que surjan con motivo del presente contrato, de su ejecución, incumplimiento, interpretación, se resolverán ante algún Centro de Resolución Alterna de Conflictos debidamente autorizado por nuestra legislación vigente, prefiriéndose en primera instancia el uso de la conciliación sin perjuicio de utilizar en caso de no lograrse una solución al diferendo a la mediación o el arbitraje, siendo éste último de un solo miembro y de equidad.-
10.- Toda comunicación referente a este contrato deberá hacerse por escrito y valdrá como fecha de aviso la del recibo por cualquiera de las partes, quedando sometido al ordenamiento jurídico costarricense así como la jurisdicción aplicable será la de la República de Costa Rica.
11.- Para cualquier comunicación que deban hacerse las partes en la ejecución de este Contrato, o bien para los efectos estipulados en la Ley de Notificaciones Judiciales No. 8687 de 4 de diciembre del 2008 las partes señalan las siguientes direcciones como su domicilio contractual:
