Artículo 128.- Lesiones culposas
Se impondrá prisión hasta de un año, o hasta cien días multa, a quien por culpa cause a otro lesiones de las definidas en los artículos 123, 124 y 125. Para la adecuación de la pena al responsable, el tribunal deberá tener en cuenta el grado de culpa, el número de víctimas y la magnitud de los daños causados.
En todo caso, al autor de las lesiones culposas también se le impondrá inhabilitación de seis meses a dos años para el ejercicio de la profesión, el oficio, el arte o la actividad en la que se produjo el hecho.
Se impondrá pena de prisión de tres meses a tres años y la inhabilitación para conducir vehículos de todo tipo, de un año a tres años a quien por culpa y por medio de un vehículo haya causado lesiones a una persona, encontrándose el autor bajo las conductas establecidas en la categoría A de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial o bajo la influencia de bebidas alcohólicas, con una concentración de alcohol en sangre superior a cero coma setenta y cinco gramos (0,75 g) por cada litro de sangre o con una concentración de alcohol en aire superior a cero coma treinta y ocho miligramos (0,38 mg) por litro.
Igual pena se aplicará en los casos en que el autor del hecho sea un conductor profesional o un conductor cuya licencia de conducir haya sido expedida por primera vez en un plazo inferior a tres años, respecto del día en que se detectó la presencia del alcohol, cuando la concentración de alcohol en sangre sea superior a cero coma cincuenta gramos (0,50 g) de alcohol por cada litro de sangre o cuando la concentración de alcohol en aire sea superior a cero coma veinticinco miligramos (0,25 mg) por litro, o bien, en los casos en que el autor del hecho se encuentre bajo la influencia de drogas tóxicas, estupefacientes, sustancias psicotrópicas u otras sustancias que produzcan estados de alteración y efectos enervantes o depresivos análogos, de acuerdo con las definiciones, los alcances y las características que haya establecido el Ministerio de Salud.
Cuando se trate de un conductor reincidente de alguna de las conductas señaladas en los párrafos anteriores, el mínimo de la pena de inhabilitación para la conducción de todo tipo de vehículos, será de tres años y el máximo podrá ser hasta de siete años.
Cuando se imponga una pena de prisión de tres años o menos, el tribunal podrá sustituir la pena privativa de libertad por una multa pecuniaria, la cual no podrá ser menor de un salario base ni mayor de tres salarios base mensual, correspondiente al «Auxiliar Administrativo Uno» que aparece en la Relación de Puestos del Poder Judicial, de conformidad con la ley de presupuesto ordinario de la República, aprobada en el mes de noviembre anterior a la fecha en que se cometa la infracción de tránsito asociado a una medida alternativa de prestación de servicio de utilidad pública, que podrá ser de doscientas horas hasta de novecientas cincuenta horas de servicio, en los lugares y la forma que se dispongan por la autoridad jurisdiccional competente.
