En derecho penal, en caso de concurso de delitos, aplicación de la pena prevista para el más grave de ellos y aumentada hasta en otro tanto, cuando las conductas son de la misma especie; se afectan bienes jurídicos patrimoniales; y el agente persigue con esa pluralidad de acciones una misma finalidad. Es así que el numeral 77 del Código Penal, establece que para el delito continuado, procede imponer: “…la sanción que corresponda al delito más grave, aumentada hasta en otro tanto…” […] Efectivamente, sobre la forma de interpretar la regla establecida en el citado numeral 77, se dijo: “… la forma correcta de fijar la sanción cuando previamente se ha establecido la existencia de un delito continuado, es la siguiente: se toma como parámetro la pena abstracta (en sus límites inferior y superior) y se duplica y una vez realizada esta operación, el Tribunal fija la sanción correspondiente, ubicándola en las nuevas dimensiones (…) en tratándose del delito de peculado (artículo 354 del Código Penal) la pena prevista es de tres a doce años de prisión y por darse la continuidad, debe multiplicarse por dos (aumentada hasta en otro tanto, dice la Ley), por lo que los extremos menor y mayor pasan a seis (6) y veinticuatro (24) años de prisión, respectivamente y luego de establecidos debe determinarse la pena, siguiendo los lineamientos del artículo 71 ibídem… (Sala Tercera, N° 673, de 10:00 horas, del 7 de agosto de 2003; […].
