En Victimología, es posible encontrar distintas clasificaciones de las víctimas, desarrolladas de acuerdo a diversos criterios. La clasificación de las víctimas según Antonio Beristain Ipiña, es considerada por los expertos como una de las más completas. Beristain entiende que hay 5 tipos principales de víctimas, que presentan distintos grados de culpabilidad.

Clases de Víctimas

1 – Completamente culpable, precipitadora

Víctima provocadora
Participación: Contribución exclusiva de la víctima al hecho victimizante no punible
Ejemplo: Agresor que muere “víctima” del agredido que se defiende legítimamente
Víctima propiciadora del delito
Participación: Contribución predominante de la víctima al hecho punible
Ejemplo: – Estafador estafado; – Borracho que fanfarronea en el bar con dinero y le hurtan la cartera
Falsa víctima (delito simulado)
Participación: Denuncia falsa
Ejemplo: Una mujer quiere vengarse de un hombre y le acusa de violación

2 – Parcialmente culpable

Víctima por ignorancia o por imprudencia
Participación: Mayor o menor contribución al hecho
Ejemplo: Mujer que fallece al provocarse el aborto
Víctima con escasa culpabilidad
Participación: Mayor o menor contribución al hecho
Ejemplo: Mujer que entrega al falso contrayente matrimonial su libreta de ahorro
Víctima voluntaria
Participación: Mayor o menor contribución al hecho
Ejemplo: Causación de la muerte de/a enfermo incurable, por su propio deseo (homicidio-suicidio)

3 – Completamente inculpable

Víctima “ideal”
Participación: Ninguna participación activa
Ejemplo: – Bomba en establecimiento público; – Persona privada de conocimiento que es robada en calle céntrica no peligrosa; – Persona dormida en coche-cama, en tren no peligroso que es robada; – Pobres
