Algunos sectores del pensamiento jurídico actual se orientan a la protección de bienes jurídicos universales,
supraindividuales, indeterminados o de contenido difuso, por lo cual resulta difícil identificar
la afectación o el efecto lesivo a una persona o personas concretas. El instrumento más utilizado para proteger estos nuevos bienes jurídicos, es el de los delitos de peligro abstracto, al estimarse inaceptable esperar a que se
le produzcan efectivas lesiones a la salud pública –o al medio ambiente, según el caso– para castigar este tipo de conductas, cuya trascendencia social se estima insoslayable, dados los efectos que tienen.
