LA TEORÍA DE LAS SUBCULTURAS DELICTIVAS Y LA CULTURA DE LA BANDA.
La sociología criminal funcionalista acuña el concepto de “subculturas criminales” para intentar explicar la conducta de jóvenes infractores de clase bajas, que adquirían durante la primera mitad del siglo XX niveles de organización preocupantes en la sociedad norteamericana. La obra de Albert COHEN “Delinquent boys. The culture of the gang”, publicada en 1956, opera como el soporte teórico fundamental de esta corriente, que pretende analizar un fenómeno criminal bastante acotado: delitos cometidos por bandas juveniles; infractores de extracción social desfavorable; delitos violentos; delincuencia expresiva y no instrumental, maliciosa y por lo tanto mucho más difícil de remover mediante estrategias de prevención social.
Una novedad que incorpora la teoría de las subculturas estriba en afirmar que estos colectivos sociales organizados y “desviados” no profesan la misma escala de valores que el resto de la sociedad. De hecho, la denominación subcultura refiere a entramados culturales diversos, que se diferencian ex profeso de la escala de valores dominante en la clase media del estado welfarista.
Esta actitud de rebeldía hacia los valores convencionales de clase media, canalizada a través del delito, intenta no tanto satisfacer expectativas de lucro o ascenso económico (delincuencia utilitaria) sino construir subjetividades y afirmar una identidad que el propio sistema les escamoteaba a esos jóvenes marginados y olvidados por una estructura social que les impedía acceder al bienestar por vías lícitas, frente a lo que surgía la desviación como respuesta (delincuencia expresiva).
Este tipo de delincuencia juvenil no se explica, para las teorías subculturales, ni por aspectos ecológicos ni por el desajuste entre metas y medios. El delito sería la consecuencia de una organización social distinta, de una escala de valores alternativa o al menos ambivalente , en la que la solidaridad interna de los grupos aparece tan importante como la valentía, el hedonismo inmediato y la maliciosidad (la satisfacción se extrae precisamente de la disconformidad de los otros o de su temor).
Por eso, Cohen no se preocupó en determinar por qué un joven se integra a una subcultura, sino por qué existen las subculturas criminales, qué factores inciden en la conformación de las mismas y de qué manera éstas se relacionan con la sociedad convencional.
Y concluyó que la estratificación social de una sociedad dividida en clases, una suerte de ambivalencia normativa (que tiene que ver con la manera en que en algún momento de su vida esos jóvenes son influidos por valores de clase media y por valores subculturales) y la frustración que produce la marginación, eran los elementos que explicaban la existencia de las subculturas.
La frustración, a su vez, es –justamente- producto de una contradicción en la escala de valores de los jóvenes de clase baja, que participan en buena medida de ambos sistemas de creencias. Porque aunque pertenezcan a sectores sumergidos, sus propios padres son inducidos a participar del estilo de vida y los patrones de la clase media, contradicción que acentúan el sistema educativo y los medios de comunicación. Pero, al intentar asomarse a esos valores, el joven de clase baja experimenta una sensación de debilitamiento de su autoestima porque no les han sido proporcionados los instrumentos de socialización para competir con éxito con los hijos de las familias de clase media.
Esta identificación con los valores de su clase, conviviendo dificultosamente con las presiones de los valores de clase media, lleva a esa ambivalencia y a esa frustración (conflicto) que el joven de condición marginada resuelve con el recurso a tres alternativas: a) el “college boy”, o joven que se adapta a los valores de clase media asumiendo los mismos a pesar de las desventajas objetivas en las que se encuentra. b) el “corner boy”, que representa la respuesta mayoritaria, ubicua, acomodaticia, probablemente más ambivalente, y radica en no romper con la sociedad oficial sino pactar con ella o adaptarse a sus modelos. Y c) el “delinquent boy”, que resuelve su frustración enfrentándose abiertamente a los valores convencionales a partir de una conducta para aquellos “desviada”.
En materia político criminal, la existencia de grupos sociales que no participan de la escala de valores convencionales supone una puesta en crisis del ideal socializador inclusivo. El joven no va a socializarse porque ha elegido vvir al margen de los patrones culturales de la clase media y la delincuencia violenta es su forma de vida habitual, en la que se socializa él y su grupo de referencia.
Esto supone, para responder a la “conservación del orden” con las lógicas que manejaba la sociología funcionalista conservadora, apelar lisa y llanamente a estrategias estatales preventivas, disuasivas o conjurativas. Dicho en otros términos, diseñar y poner en práctica una estrategia policial.
Para ello, la prevención situacional (mayor vigilancia policial) debe intensificarse, incluso apelando a la disuasión como paso previo a la conjuración de los delitos que eventualmente cometan estos grupos.
