La Criminología Crítica como tal, surgió en los años setentas del siglo anterior, originalmente como un movimiento que llevó a los criminólogos a posiciones contrarias al régimen social. En Estados Unidos, la Criminología Radical adoptó ese enfoque, en que en Inglaterra y en el resto del mundo se denominó Criminología Crítica. Esta corriente se nutre de dos fuentes: el marxismo y la filosofía crítica. Cuestiona, por igual, la capacidad de la ciencia positiva, a la que entiende como uno de los elementos o instrumentos de las fuerzas del poder, y a la sociedad misma, enajenante y opresora. Pregona, para los criminólogos, el compromiso de acción política y aspira a la desaparición del problema criminal por medio del paso a un nuevo orden social en que no hay necesidad del derecho penal tal y como lo conocemos hoy. Quizás sus más destacados fundadores sean Ian Taylor, Paul Walton y Jock Young, pero rápidamente se extendió; otros, entre muchos, que hicieron aportes son Massimo Pavarini y Alesandro Baratta. En América Latina, Lolita Aniyar de Castro ha sido una preclara defensora de este movimiento[xxii].
Sobre la base de esta premisa, esta perspectiva criminológica criticó que los problemas causados por la pobreza, el racismo, la discriminación o las guerras, fueran invisibles para el Derecho penal y en consecuencia que este se centrase en el delito común, el realizado en la calle, por una persona, habitualmente pobre, que se adecua a nuestro estereotipo de delincuente. Este sesgo del sistema penal fue combatido con una cierta idealización del delincuente, al interpretarse sus actos no sólo como producto de una determinada organización social, sino también como una protesta contra este orden social.
