El Tercio de la Pena Costa Rica

Este Programa Semiinstitucional recibe los casos valorados positivamente por el INC, ya sea por valoración ordinaria o por valoración extraordinaria.

La valoración ordinaria procede cuando el privado de libertad cumple el primer tercio de la pena y, sin importar el tipo de delito, el Consejo Técnico Interdisciplinario de cada centro penitenciario analiza si puede pasar o no al Programa Semiinstitucional. Todos los privados de libertad tienen derecho a una valoración del equipo técnico para el cambio de programa en los siguientes plazos:

  • a) Para sentencias condenatorias hasta de un año de prisión, se valorará una vez que se haya cumplido el primer tercio de la pena.
  • b) Para sentencias condenatorias de más de un año y hasta tres años de prisión, la valoración se realizará cada seis meses.
  • c) Para sentencias condenatorias de más de tres años y hasta doce años de prisión, la valoración se realizará cada año.
  • d) Para sentencias condenatorias mayores de 12 años de prisión, la valoración se realizará cada dos años. Para este tipo de sentencias, a partir de que reste por descontar tres años de la sentencia, las valoraciones se realizarán anualmente.

Esa valoración técnica podrá incluir recomendaciones ante el INC para el cambio de modalidad de custodia y pernoctación. Si la persona privada de libertad tiene varias sentencias por descontar, el cambio de programa se podrá recomendar hasta que haya cumplido el tercio de la pena total de la última sentencia.

En los casos del punto d) anterior, se realizará una valoración extraordinaria cuando la persona privada de libertad cumpla con el primer tercio de la pena impuesta, con el único objetivo de determinar si es apta o no para un cambio de programa.

La valoración extraordinaria permite que se hagan valoraciones fuera de los plazos ordinarios establecidos, dependiendo de las circunstancias de la persona o por necesidades institucionales debidamente fundamentadas (como la situación del hacinamiento). Esa valoración procede, igualmente, en virtud del principio de humanidad en el cumplimiento de la pena, independientemente de que el privado de libertad haya cumplido o no el tercio, pero excluye algunos delitos como abusos sexuales agravados, homicidios calificados, tráfico internacional de drogas, entre otros.
