Comunicabilidad de las circunstancias
En principio, los datos, relaciones o características que concurren en el autor del injusto,
no se transmiten al partícipe, salvo que este las hubiera conocido o actuara determinado
por ella, según el caso.
El artículo 49 de nuestro Código Penal refiere que:
Las calidades personales constitutivas de la infracción son imputables también a los
partícipes que no las posean, si eran conocidas por ellos.
Las relaciones, circunstancias y calidades personales cuyo efecto sea disminuir o excluir
la penalidad, no tendrán influencia sino respecto a los partícipes en quienes concurran.
Las circunstancias materiales que agraven o atenúen el hecho sólo se tendrán en cuenta
respecto de quien, conociéndolas, prestó su concurso.
