Código Penal Nombramientos ilegales
El artículo 344 del Código Penal incluye el
delito de nombramientos ilegales, el cual
consisten en:
“Será reprimido con treinta a noventa
días multa el funcionario público
que propusiere o nombrare para
cargo público a persona en quien no
concurrieren los requisitos legales.”
El delito consiste en proponer y nombrar a
una persona para un cargo para el cual no
posee los requisitos ni las competencias
legales, este delito lamentablemente es
muy común en la función pública, y cómo
auditores y abogados debemos estar
conscientes que nos podemos encontrar
con nombramientos de este tipo, en donde
se designa a un funcionario por orden de
un superior aun cuando dicho funcionario
no posee las competencias para el puesto,
teniendo el funcionario proponente pleno
conocimiento de la carencia de requisitos
del funcionario propuesto; por lo tanto, es un
delito que se comete con dolo.
Este delito es por acción, y lo puede cometer
únicamente el funcionario público que posee
la potestad de nombrar a otro funcionario
en cargos públicos, de tal manera, que si
el autor no es la persona que posee esta
potestad se podría estar ante otro tipo de
delito, como el abuso de autoridad o tráfico
de influencias. Para cometer este ilícito es
necesario poseer la potestad legal de incurrir
en la acción prohibida.
