Artículo 238.- Aplicación de la prisión preventiva
La prisión preventiva solo podrá ser acordada conforme a las disposiciones de este Código, mediante resolución judicial fundada, en los límites indispensables para asegurar el descubrimiento de la verdad y la actuación de la Ley. Cuando el Ministerio Público estime que procede la prisión preventiva, solicitará al juez correspondiente que convoque a una audiencia oral, en la que se discutirá sobre la procedencia o no de esa medida. Si la persona se encontrare detenida, la solicitud de audiencia deberá pedirse dentro de las veinticuatro horas, contadas desde que el encausado se puso a la orden del juez; la audiencia deberá celebrarse dentro de las cuarenta y ocho horas y la resolución deberá ser dictada dentro de ese plazo.
Corresponde al Ministerio Público y la defensa del imputado, aportar la prueba en la que fundamente sus peticiones.
Terminada la audiencia, el juez resolverá sobre lo solicitado. Si contare con medios de grabación, el respaldo de ellos será suficiente para acreditar la existencia de la celebración de la audiencia y de lo resuelto.
Se ejecutará del modo que perjudique lo menos posible a los afectados.
La privación de libertad, durante el procedimiento, deberá ser proporcional a la pena que pueda imponerse en el caso.

Artículo 239 bis.- Otras causales de prisión preventiva
Previa valoración y resolución fundada, el tribunal también podrá ordenar la prisión preventiva del imputado, cuando se produzca cualquiera de las siguientes causales, el delito esté sancionado con pena de prisión y se cumpla el presupuesto establecido en el artículo 37 de la Constitución Política :
a) Cuando haya flagrancia en delitos contra la vida, delitos sexuales y delitos contra la propiedad en los que medie violencia contra las personas o fuerza sobre las cosas, y en delitos relacionados con estupefacientes, sustancias psicotrópicas, drogas de uso no autorizado, legitimación de capitales y actividades conexas.
b) El hecho punible sea realizado presumiblemente por quien haya sido sometido al menos en dos ocasiones, a procesos penales en los que medie violencia contra las personas o fuerza sobre las cosas, en los cuales se hayan formulado acusación y solicitud de apertura a juicio por parte del Ministerio Público, aunque estos no se encuentren concluidos.
c) Cuando se trate de personas reincidentes en la comisión de hechos delictivos en los que medie violencia contra las personas o fuerza sobre las cosas.
d) Se trate de delincuencia organizada.

ARTICULO 240.-
Peligro de fuga Para decidir acerca del peligro de fuga se tendrán en cuenta, especialmente, las siguientes circunstancias:
a) Arraigo en el país, determinado por el domicilio, residencia habitual, asiento de la familia, de sus negocios o trabajo y las facilidades para abandonar definitivamente el país o permanecer oculto. La falsedad, la falta de información o de actualización del domicilio del imputado constituirá presunción de fuga.
b) La pena que podría llegarse a imponer en el caso.
c) La magnitud del daño causado.
d) El comportamiento del imputado durante el procedimiento o en otro proceso anterior, en la medida que indique su voluntad de someterse a la persecución penal.

ARTICULO 241.-
Peligro de obstaculización Para decidir acerca del peligro de obstaculización para averiguar la verdad se tendrá en cuenta, especialmente, la grave sospecha de que el imputado:
a) Destruirá, modificará, ocultará o falsificará elementos de prueba.
b) Influirá para que coimputados, testigos o peritos informen falsamente o se comporten de manera desleal o reticente, o inducirá a otros a realizar tales comportamientos.
El motivo sólo podrá fundar la prisión hasta la conclusión del debate.

ARTICULO 242.-
Prueba para la aplicación de medidas cautelares El fiscal o, en su caso el Tribunal, podrán recibir prueba, de oficio o a solicitud de parte, con el fin de sustentar la aplicación, revisión, sustitución, modificación o cancelación de una medida cautelar. Dicha prueba se agregará a un legajo especial cuando no sea posible incorporarla al debate. El tribunal valorará estos elementos de prueba conforme a las reglas generales establecidas en este Código y exclusivamente para fundar la decisión sobre la medida cautelar. Si el tribunal lo estima necesario, antes de pronunciarse, podrá convocar a una audiencia oral para oír a las partes o para recibir directamente la prueba. De dicha audiencia se levantará un acta.

ARTICULO 243.-
Resolución que acuerda la prisión preventiva La prisión preventiva sólo podrá decretarse por resolución debidamente fundamentada, en la cual se expresen cada uno de los presupuestos que la motivan. El auto deberá contener:
a) Los datos personales del imputado o los que sirvan para identificarlo.
b) Una sucinta enunciación del hecho o hechos que se le atribuyen.
c) La indicación de las razones por las cuales el tribunal estima que los presupuestos que motivan la medida concurren en el caso.
d) La cita de las disposiciones penales aplicables.
e) La fecha en que vence el plazo máximo de privación de libertad.

ARTICULO 244.-
Otras medidas cautelares Siempre que las presunciones que motivan la prisión preventiva puedan ser evitadas razonablemente con la aplicación de otra medida menos gravosa para el imputado, el tribunal competente, de oficio o a solicitud del interesado, deberá imponerle en su lugar, en resolución motivada, alguna de las alternativas siguientes:
a) El arresto domiciliario, en su propio domicilio o en custodia de otra persona, sin vigilancia alguna o con la que el tribunal disponga. b) La obligación de someterse al cuidado o vigilancia de una persona o institución determinada, que informará regularmente al tribunal. c) La obligación de presentarse periódicamente ante el tribunal o la autoridad que él designe. d) La prohibición de salir sin autorización del país, de la localidad en la cual reside o del ámbito territorial que fije el tribunal. e) La prohibición de concurrir a determinadas reuniones o de visitar ciertos lugares. f) La prohibición de convivir o comunicarse con personas determinadas, siempre que no se afecte el derecho de defensa. g) Si se trata de agresiones a mujeres y niños o delitos sexuales, cuando la víctima conviva con el imputado, la autoridad correspondiente podrá ordenarle a este el abandono inmediato del domicilio. h) La prestación de una caución adecuada. i) La suspensión en el ejercicio del cargo cuando se le atribuye un delito funcional.
Si la calificación jurídica del hecho admite la aplicación de una pena de inhabilitación, el tribunal podrá imponerle, preventivamente, que se abstenga de realizar la conducta o la actividad por las que podría ser inhabilitado.
